By visiting nyaxe.com, creating an account, making a booking, or otherwise using our site (the “Site”), you agree to these Terms. If you don’t agree, please don’t use the Site.

2) Changes

We may update these Terms at any time. If we make material changes, we’ll post the new version here with a new “Effective date.” Continued use means you accept the changes.

3) Eligibility

The Site is for individuals 13+. You must be 18+ to make purchases or bookings. If you use the Site on behalf of a company, you confirm you have authority to bind that company.

4) Your Account

Keep your login details confidential and notify us promptly of any unauthorized use. You’re responsible for activity under your account.

5) Permitted Use

Use the Site only for lawful purposes and in a way that doesn’t harm, disable, or overload our systems or interfere with others’ use.

6) Prohibited Conduct (examples)

You agree not to:

  • Upload malware or attempt to gain unauthorized access.
  • Scrape or harvest data without written permission.
  • Post or transmit unlawful, infringing, or harmful content.
  • Misrepresent your identity or affiliation.

We may suspend or terminate access for violations.

7) Bookings, Payments & Policies

If you book experiences, buy gift cards, or purchase merchandise through the Site, those transactions are subject to any posted policies at checkout (e.g., pricing, deposits, rescheduling/cancellation windows, no-show fees, age/ID requirements).

  • Taxes/fees: Displayed at checkout.
  • Third-party processors: Payments may be handled by trusted providers; their terms and privacy policies apply.
  • Waivers & safety: Participation in axe-throwing requires agreeing to our on-site waiver and safety rules. The online Terms do not replace the activity waiver.

8) Intellectual Property

All content on the Site (text, graphics, logos, photos, video, software, and look-and-feel) is owned by NY Axe or our licensors and protected by law. You may use the Site for personal, non-commercial purposes. Don’t copy, modify, distribute, or make derivative works without our written consent.

9) Your Content

If you submit reviews, photos, or other materials (“User Content”), you grant us a non-exclusive, worldwide, royalty-free license to host, display, and share that content to operate and promote the Site and our services. You promise you have the rights to the content you submit and that it doesn’t infringe others’ rights. We may remove content at our discretion.

10) Third-Party Links & Services

The Site may link to third-party websites or use third-party services (e.g., booking, payments, analytics). We don’t control and aren’t responsible for those sites/services. Their terms and privacy practices apply.

11) Disclaimers

The Site and all content are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties (express or implied), including merchantabilityfitness for a particular purpose, and non-infringement. We do not guarantee the Site will be error-free or uninterrupted.

12) Limitation of Liability

To the fullest extent permitted by law, NY Axe and our owners, employees, and partners will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits/revenue/data arising out of or related to use of the Site. Our total liability for any claim related to the Site will not exceed the greater of (a) $100 or (b) the amount you paid to us for the transaction giving rise to the claim.

Some jurisdictions don’t allow certain limitations—if so, those limits apply only to the extent permitted.

13) Indemnification

You agree to defend, indemnify, and hold NY Axe harmless from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Site or violation of these Terms.

14) DMCA / Copyright

If you believe content on the Site infringes your copyright, send a notice to our DMCA Agent with:
(1) your signature, (2) identification of the work and the allegedly infringing material, (3) your contact info, (4) a statement of good-faith belief, and (5) a statement that your notice is accurate under penalty of perjury.

16) Termination

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. You agree to exclusive jurisdiction and venue in the state or federal courts located in Nassau County, New York.

18) Miscellaneous

These Terms are the entire agreement between you and NY Axe regarding the Site and supersede prior communications. If any section is unenforceable, the rest remains in effect. We may assign these Terms; you may not assign them without our consent. No waiver is effective unless in writing.

The Site is for individuals 13+. You must be 18+ to make purchases or bookings. If you use the Site for a company, you confirm you’re authorized to bind that company.

4) Your Account

Keep credentials confidential and tell us promptly about unauthorized use. You’re responsible for activity under your account.

5) Permitted & Prohibited Use

Use the Site lawfully and without disrupting our systems or others’ use. Don’t upload malware, scrape without permission, misrepresent your identity, or post unlawful/infringing content. We may suspend/terminate access for violations.

6) Bookings, Payments & Refunds

Transactions (bookings, gift cards, merchandise) are subject to policies shown at checkout. Payments may be processed by trusted third parties, whose terms and privacy practices also apply.

Refunds: Refunds are permitted for cancellations made more than 24 hours before your scheduled booking. Cancellations made within 24 hours of the scheduled time are non-refundable. (Any taxes/fees will be shown at checkout.)

Waivers & safety: Participating in axe-throwing requires agreement to our on-site waiver and safety rules. These Terms don’t replace the activity waiver.

NY Axe – Privacy Policy

1) What we collect

  • Identifiers & contact info: name, email, phone, postal address.
  • Booking details: party size, date/time, payment status, gift cards.
  • Payment info: processed by third-party providers (we don’t store full card numbers).
  • Waiver & safety info: signatures, age/ID, acknowledgements, incident reports.
  • Communications & marketing prefs: emails, SMS opt-ins/opt-outs.
  • Usage data: pages viewed, links clicked, device/browser, approximate location (from IP).
  • Photos & video (optional): if you share content with us or agree to on-site media.
  • CCTV/on-site cameras: for security and loss prevention at our venues.

2) How we collect it

  • Directly from you: bookings, forms, waivers, email/SMS, phone.
  • Automatically: cookies, pixels, and similar technologies on our site.
  • From service providers: booking systems, payment processors, analytics, ad platforms, review sites (if you choose to post).

3) Why we use it (purposes)

  • Provide services: manage bookings, take payments, confirm reservations, customer support.
  • Safety & compliance: age/ID checks, waivers, venue security, legal obligations.
  • Improve & secure our site: analytics, debugging, fraud prevention.
  • Marketing with consent: email/SMS offers, ads, look-alike/retargeting where allowed.
  • Business operations: accounting, audits, recordkeeping, reporting.

4) Sharing your information

We share data with service providers that help us run the business (e.g., booking platforms, payment processors, email/SMS tools, analytics and advertising partners). We may disclose information if required by law or in connection with a business transfer (e.g., merger). We don’t sell your personal information for money. Some advertising/analytics uses can be considered a “sale” or “sharing” under certain state laws; see Your Privacy Rights below for opt-out options.

5) Cookies, analytics & ads

We use cookies and similar tech to remember preferences, measure site performance, and show relevant ads. You can:

6) SMS & email marketing

  • SMS: By opting in, you agree to receive texts from NY Axe. Message/data rates may apply. Frequency varies. Text STOP to cancel and HELP for help. Consent is not a condition of purchase. Carriers aren’t liable for delays or failures.
  • Email: You can unsubscribe using the link in the email or by contacting us at events@nyaxe.com.

7) Children

Our website is not directed to children under 13. We don’t knowingly collect personal information from children under 13. If you believe a child provided information, contact us to delete it.

8) Data retention

We keep information only as long as needed for the purposes above, to comply with legal obligations, resolve disputes, and enforce our agreements (for example, tax/audit rules and incident reports may require longer retention).

9) Security

We use reasonable administrative, technical, and physical safeguards to protect personal information. No system is 100% secure; please use strong, unique passwords and let us know about suspected issues.

10) Your privacy rights (U.S. states including CA/VA/CO/CT, where applicable)

Subject to verification and exceptions, you may have the right to accesscorrectdelete, and limit/opt-out of “sale” or “sharing” for cross-context behavioral advertising.

  • Opt-out of sale/sharing: Email us or use the “Do Not Sell or Share My Personal Information” link (if available).
  • Authorized agents: May submit on your behalf with proof of authority.
    We will not discriminate against you for exercising your rights.

Global Privacy Control (GPC): Where required by law, we treat a valid GPC signal as a request to opt-out of sale/sharing for the browser sending the signal.

11) Do Not Track

Some browsers send “Do Not Track” signals. We currently do not respond to DNT, but we honor opt-out rights required by applicable law (see above).

12) Third-party links & services

Our site may link to other websites or integrate third-party services (e.g., bookings, payments, analytics). Their privacy practices apply to their services; we’re not responsible for their content or policies.

13) International users

Our services are intended for the U.S. If you access the site from outside the U.S., you consent to processing in the U.S., where laws may differ from your country’s.
